1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Entrants may enter the contest by fully completing and submitting the entry form online at http://sneakattackmedia.com/vfc. If entry is made online and more than one person shares an email account or ISP account, the person responsible for paying any service charges associated with the account or the person deemed to be the account holder by the ISP will be deemed the winner in the event that that entry is selected. Only one entry is allowed per person/email address per day for the duration of the contest. The following promotion is intended for viewing and participation in the 50 United States and District of Columbia only and shall be construed and evaluated only according to United States law. Do not proceed in the Sweepstakes website if you do not reside in the United States at the time of entry. Void where prohibited, taxed or restricted. Sweepstakes begins at 12:00:01 a.m. Pacific Time (PT) on or about November 20, 2008 and ends at 11:59:59 p.m. PT on December 1, 2008 (“Promotion Period”).2. ELIGIBILITY. Open to legal residents of the 50 United States and District of Columbia who are 13 years of age or older and are located in the U.S. at time of entry, except that employees, officers or directors of Sneak Attack Media ("Sponsor"), Sneak Attack Media ("Sweepstakes Administrator"), Capitol Records ("Partners"), their respective parents, affiliates, subsidiaries (collectively, the "Sweepstakes Entities"), or their agencies or independent contractors who are engaged in the development, production or distribution of materials related to this Sweepstakes or the implementation of this Sweepstakes, and members of the immediate families or households of each of the above are not eligible to participate.
3. HOW TO ENTER: To enter: During the Promotion Period, follow the links at http://sneakattackmedia.com/vfc ("Website") to the Sweepstakes page, then follow the instructions to complete and submit an official entry. Once submitted, entry cannot be deleted, modified or canceled. All entries must be received during the Promotion Period. Limit one (1) entry per e-mail address. Multiple entries will be disqualified. Entries become the property of the Sweepstakes Entities and will not be returned. Entries will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an Internet service provider, online service provider, or other organization that is responsible for assigning e-mail addresses. If multiple entries are received from any person or e-mail address in violation of these Official Rules, all entries from that person will be disqualified. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. By entering the Sweepstakes, you agree that your entry and any other information collected in connection with your entry (including without limitation any mobile phone information) may be used by the Sweepstakes Administrator in accordance with its Privacy Policy (please see Privacy Policy for more information) and may be shared with its affiliated business entities, Sponsor or Partners, if you opt-in to receive email, text messages or other communications from Sweepstakes Administrator. You may subsequently opt-out of the receipt of such email or communications by following the directions in the email or communications. Entrants may also receive information from Sponsor, Partners and participating contributors via e-mail by "opting in" on the Sweepstakes entry page.
4. WINNING: Winners will be selected by random drawing from among all eligible entries received, approximately 60 days after the end of the Promotion Period (at Administrator's discretion), conducted by judges selected by Sponsor (Judges) from among all eligible entries received. Potential winners will be notified by regular mail, email and/or phone (at Sweepstakes Administrator’s discretion) after the drawing, and are subject to verification of eligibility and compliance with these Official Rules. Participants agree to be bound by these Official Rules and the decisions of the Judges, which are final and binding in all respects. Odds of winning a prize depend on the total number of eligible entries received. All prizes will be awarded assuming sufficient eligible entries are received.
5. PRIZES: Grand Prize (1): One (1) 8 GB iPod Nano (ARV): $149.00 and one (1) copy of Varsity Fanclub’s “Future Love” single (ARV): $1.00 Total ARV of all prizes offered: $150.00. Runners up (3): One (1) copy of Varsity Fanclub’s “Future Love” single (ARV): $1.00 All items or expenses not specifically mentioned as being included are excluded. All federal, state and local taxes, if any, and any other incidental costs or expenses not identified in these rules are the responsibility of the winners. All prizes are provided "AS IS" with no warranty or guarantee by Sweepstakes Entities, either express or implied. Any and all warranties and/or guarantees with respect to a prize (if any) are subject to the respective manufacturers' terms therefore, and winners agree to look solely to such manufacturer(s) for any such warranty and/or guarantee. Prizes will be delivered 6-8 weeks after verification of winners.
6. CLAIMING PRIZE: Potential prize winners must claim their prize by responding within three (3) business days after the date of notification or attempted notification in the manner directed in the notification, and may be required to complete, sign and return an affidavit of eligibility, liability, and publicity release by the deadline stated in the notification. In the event of noncompliance, or if the entrant cannot be contacted at the address, email address or telephone number on his or her entry form, or if prize/prize notification is undeliverable or returned as unclaimed, prize will be forfeited and an alternate potential winner may be selected. Prize is non-transferable with no substitutions except at Sponsor's sole discretion, in which case a prize of equal or greater value will be awarded. Except where prohibited by law, acceptance of prize also constitutes permission to use by the Sweepstakes Entities of winner's name, biographical information, voice and/or likeness for promotional and/or advertising purposes in all media throughout the world now known or hereinafter developed, in perpetuity without notice, limitation, or compensation.
7. CONDITIONS: Limit one prize per person, family or household address. Participants agree that the Sweepstakes Entities are not responsible for any: (a) lost, late, misdirected, damaged, forged, incomplete, illegible, or garbled entries; (b) telephone, computer, hardware, software, programming, or network malfunction or other technical failures or errors, or the failure to properly process entries; (c) communication disruption or other forces beyond the reasonable control of the Sweepstakes Entities, including but not limited to disruption related to Internet traffic, virus, bug or non-authorized intervention; or (d) damage caused by computer virus or otherwise resulting to any computer from such person's access to the Website whether human, mechanical or electronic. If such malfunction, error, disruption or damage occurs, and impairs the administration, security, fairness, integrity or proper play of the Sweepstakes, the Sweepstakes Administrator may, in its sole discretion, modify, suspend or terminate the Sweepstakes by posting a notice on the Website. If the Sweepstakes is terminated before the end date, Sweepstakes Administrator may determine winners from all eligible entries received as of the termination date. Persons found tampering with or abusing any aspect of this Sweepstakes or whom Sweepstakes Administrator believes to be causing malfunction, error, disruption or damage will be disqualified. Participants agree to release, indemnify and hold harmless the Sweepstakes Entities, their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any claim, injury, loss or damage of any kind to any person, including without limitation disability and death, any contractual, intellectual or other proprietary rights, and any damage or loss to property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, or participation in this Sweepstakes, or any Sweepstakes related activity.
8. DISPUTES. THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF NEW YORK, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this sweepstakes, each participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this sweepstakes shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York, having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for and hereby waives all rights to claim punitive; incidental; or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this sweepstakes), and participant further waives all rights to have damages multiplied or increased.

I am participating in the "_________________" sweepstakes (the "Sweepstakes") organized by _____________________ ("_________") the rules of which are attached hereto as Exhibit "A" (the "Rules"). The prizes awarded under the Sweepstakes shall be as set forth in the Rules and require the winner to engage in certain activities (the "Activities") some of which are as follows: traveling by _______________________ [AIRPLANE, LIMO, ETC.] to _____________(the "Location") with the group of recording artists professionally known as "_______________" ("Artist"). For good and valuable consideration, the receipt and sufficiency of which I hereby acknowledge, I hereby agree as follows:1. I hereby certify, represent, warrant and agree that: (a) I am a legal resident of the continental United States residing and physically located in the United States, (b) I am twenty-one (21) years of age or older, (c) I am eligible to enter the Sweepstakes and have complied and shall comply with the Rules in all respects and I desire to perform the Activities, (d) I am not an employee of, a member of the immediate family of an employee of, or living in the same household with an employee of ____________ or any of ____________’s advertising or promotion agencies, parent companies, agents, officers, subsidiaries or affiliates, or any other persons or entities directly associated with the Sweepstakes, (e) I was not involved in the development, production, implementation and distribution of the Sweepstakes, (f) I will be responsible for any taxes due in connection with the receipt of a prize in connection with the Sweepstakes and I will complete and return herewith the attached IRS W-9 form, (g) I possess a valid United States government issued passport (or other valid United States government issued identification card) and have attached to this document as Exhibit "B" hereto a photocopy of that passport showing my photograph and passport number, and (h) I shall cause the person accompanying me as a guest in connection with the Activities to execute the affidavit attached hereto as Exhibit "C".
2. I hereby acknowledge, warrant, represent, verify and agree that I am able and qualified to perform the Activities, that I am familiar with the Activities and understand that the Activities are, by their very nature, hazardous activities which may cause injury to me, my guest and/or to others as well as damage to property.
3. I am fully aware that the Activities and my participation therein involve risks and dangers of serious bodily injury, including permanent disability and death, that such risks and dangers may be caused by my own actions or inactions, ____________’s actions or inactions, or actions or inactions of third parties, the conditions under which such Activities take place, and/or ____________’s negligence, my negligence or that of third parties, and that there may be other risks and dangers not readily foreseeable or known to me at this time or at the time of my participation in the Activities. I hereby irrevocably and forever waive, release, discharge, hold harmless and disclaim ____________ and Artist and each of their respective directors, officers, agents, representatives, employees, and parents, subsidiaries and affiliates, directors, officers, agents (collectively, the "Released Parties") from and against any and all claims, costs, losses, injuries, causes of action, lawsuits and demands, attorneys' fees, expenses or other liabilities of any kind (now known or unknown) which I, my guest or any party claiming by, through or for me or my guest may have had, now has or hereafter may have against one or more of the Released Parties arising out of or in any way relating to the Sweepstakes or the Activities, no matter how they may be caused.
5. I HAVE READ AND FULLY UNDERSTAND ALL OF THE ABOVE AND VOLUNTARILY ASSUME THE ENTIRE RISK OF LOSS, DAMAGE AND INJURY TO ME, TO ANY OTHER PERSON, AND TO ANY PROPERTY RESULTING FROM OR RELATING TO MY PERFORMANCE OF THE ACTIVITIES. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT I AM GIVING UP SUBSTANTIAL RIGHTS AND I DO SO FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE.
